3. Account Registration and Eligibility

3.1 Account Creation

  • You must provide accurate, complete information during registration including name and valid email address
  • You are responsible for maintaining the confidentiality of your account credentials and password hash
  • You must notify us immediately of any unauthorized access to your account
  • One person may not maintain multiple accounts without prior written consent

3.2 Eligibility Requirements

  • You must be at least 18 years old to use the Service
  • You must have the legal authority to enter into this agreement
  • You must not be prohibited from using the Service under applicable law
  • You must operate a legitimate restaurant or food service business

3.3 Team Accounts and Restaurant Management

  • Team administrators are responsible for managing team member access and roles
  • Team administrators are liable for all activities under their team account
  • Team members' access is subject to role-based permissions (member, admin, etc.)
  • Each restaurant location requires proper verification and accurate business information
  • You may manage multiple restaurant locations under a single team account

4. Subscription Plans and Billing

4.1 Subscription Tiers

Our Service is offered through various subscription plans with different features:

4.2 Billing and Payment

  • Subscription fees are billed in advance on a monthly or annual basis
  • All payments are processed securely through Stripe
  • We store Stripe Customer ID, Subscription ID, and Product ID for billing management
  • Prices are exclusive of applicable taxes unless otherwise stated
  • Failed payments may result in service suspension after notification and reasonable cure period

4.3 Plan Changes and Usage Monitoring

  • You may upgrade or downgrade your plan at any time through your account dashboard
  • Upgrades take effect immediately with prorated billing
  • Downgrades take effect at the next billing cycle
  • Token usage is tracked daily per team and restaurant
  • Excessive usage may result in temporary service restrictions based on your plan limits

4.4 Refunds and Cancellation

  • Monthly subscriptions may be canceled at any time with effect at the end of the current billing period
  • Annual subscriptions may be subject to different refund policies as outlined at time of purchase
  • No refunds are provided for partial months except as required by applicable law
  • Upon cancellation, your data will be retained for 30 days for potential account recovery

5. Acceptable Use Policy

5.1 Permitted Uses

  • Use the Service for legitimate restaurant recommendation and analytics purposes
  • Upload accurate restaurant and menu data including dishes, prices, ingredients, allergens, and nutritional information
  • Customize branding elements within provided tools (logos, colors, welcome messages)
  • Generate embed codes to integrate recommendation widgets into your restaurant website
  • Collect and analyze customer feedback on recommendations

5.2 Prohibited Uses

You may not:

  • Use the Service for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction including food safety, consumer protection, or advertising regulations
  • Upload false, misleading, or inaccurate restaurant or menu information
  • Transmit any malicious code, viruses, or harmful software
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Reverse engineer, decompile, or attempt to extract source code
  • Share or distribute embed codes with unauthorized parties
  • Use the Service to spam or send unsolicited communications
  • Impersonate others or provide false information about your business identity
  • Interfere with or disrupt the Service or servers connected to the Service

5.3 Content Standards

  • Restaurant and menu data must be accurate, current, and not misleading to customers
  • Uploaded content must not infringe intellectual property rights
  • Content must not be offensive, discriminatory, or harmful
  • You are responsible for ensuring compliance with food safety regulations and accurate allergen information
  • Nutritional information, if provided, must be accurate and compliant with local regulations

6. Intellectual Property Rights

6.1 Our Rights

  • The Service, including all software, AI algorithms, recommendation engines, and documentation, is our proprietary property
  • Our trademarks, logos, and brand elements are protected intellectual property
  • You receive a limited, non-exclusive, non-transferable license to use the Service during your subscription period

  • You retain ownership of your restaurant data, menu information, logos, and custom content
  • You grant us a license to use your data solely to provide the Service, generate recommendations, and create analytics

9. User Responsibilities

9.1 Data Accuracy and Maintenance

  • You are responsible for maintaining accurate restaurant information, menu data, prices, and availability
  • Inaccurate or outdated data may result in poor recommendation quality and customer dissatisfaction
  • You must update menu information, prices, and availability promptly when changes occur
  • Allergen and dietary information must be accurate and regularly verified

9.2 Legal and Regulatory Compliance

  • You must comply with all applicable laws and regulations including food safety, consumer protection, and advertising laws
  • You are responsible for obtaining necessary business licenses and food service permits
  • Menu pricing and promotional content must comply with local regulations
  • You must handle customer data and feedback in accordance with applicable privacy laws

9.3 Security and Access Management

  • You must implement reasonable security measures for embed codes and account access
  • Team administrators must properly manage member roles and permissions
  • Report any security incidents, data breaches, or vulnerabilities immediately
  • Do not share account credentials with unauthorized parties
  • Monitor and audit team member access regularly
  • Ensure embed codes are only used on your authorized websites

10. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.
